Terms of Service for ALOA THE LABEL AS
Introduction
These standard terms of sale govern consumer purchases of goods over the Internet from ALOA THE LABEL AS. Purchases are regulated by the Norwegian Contract Act, Consumer Purchase Act, Marketing Act, Right of Withdrawal Act, and the E-commerce Act – laws that provide consumers with non-waivable rights. These laws are available at www.lovdata.no. The terms do not limit your statutory rights but outline the main rights and obligations in our transactions. While originally designed for the Norwegian market, these terms now also apply to our international customers. Please note that additional local consumer protection laws may also apply.
1. The Agreement
The agreement consists of these terms of sale, information provided during the order process, and any specially agreed terms. In the event of any conflict, specially agreed terms that do not contravene mandatory legislation will prevail. This agreement is further supplemented by the legal provisions governing the purchase of goods between businesses and consumers.
2. The Parties
The seller is ALOA THE LABEL AS, located at Grenseveien 71, 0663 OSLO, Norway (email: hello@aloalabel.com, org. no.: 932030772). The buyer is the consumer who places an order on our website.
3. Price
The stated price for our goods is the total amount payable, inclusive of all taxes and additional costs disclosed prior to purchase. For international orders, please note that local duties, taxes, and import fees may apply at delivery and are the buyer’s responsibility.
4. Conclusion of the Agreement
The agreement becomes binding once the buyer submits an order and receives a confirmation email. If any typographical or clerical errors are identified in our offer or in the buyer’s order, and such errors are or should be apparent, the agreement may be adjusted accordingly.
5. Payment
Payment is due for the goods from the time they are dispatched. We accept payment via Stripe (Visa, MasterCard, American Express, and Apple Pay), Vipps, and invoice payments through Klarna. When paying by invoice, an invoice is issued upon shipment and is due within at least 14 days of receipt. Buyers under 18 are not eligible for invoice payments.
6. Delivery
Delivery is deemed to occur when the buyer (or their representative) takes possession of the goods. If no specific delivery time is stated, the seller will deliver the goods without undue delay and no later than 30 days after order placement. All orders are dispatched from our warehouse in Oslo, Norway via mailboxes or post offices. Tracking details are provided via email once the goods are shipped. For international shipments, customs clearance may cause delays—and such delays are beyond our control.
7. Risk of the Goods
The risk in the goods passes to the buyer upon delivery, i.e. when the buyer (or their representative) takes possession of the item.
8. Right of Withdrawal and Returns
Unless the agreement is exempt, the buyer may cancel the purchase in accordance with the Right of Withdrawal Act. This right applies primarily to consumers in Norway, the EU, and the EEA. The buyer must notify us of their intention to withdraw within 14 days from the commencement of the withdrawal period (which starts the day after receipt of the goods).
- For domestic orders within Norway, we offer a 30-day free return policy, allowing you to test the goods in a reasonable manner without forfeiting your right of withdrawal.
- For international orders, please note that we do not offer free returns or exchanges. The 30-day return period still applies, but the customer is responsible for arranging and paying for the return shipment. If the testing of the goods exceeds what is reasonable and necessary, the buyer may be held responsible for any reduced value.
Upon exercising the right of withdrawal, the goods must be returned to us without undue delay and no later than 14 days after notifying us of your decision. We will refund the purchase price within 14 days of receiving the returned goods or proof of return.
9. Delay, Non-Delivery, and Cancellation
If we do not deliver the goods or deliver them late—without the delay being attributable to the buyer—you may, in accordance with the Consumer Purchase Act, withhold payment, demand fulfillment, cancel the order, and/or claim compensation. Any claims should be submitted in writing (for example, via email). Should delivery exceed any additional reasonable period provided after a delay, you may cancel the purchase. Claims for compensation must be made promptly upon awareness of the delay.
10. Defects and Complaints
Should the goods have defects, you must notify us within two months of the defect’s discovery (and no later than two years after receipt of the goods, or five years for items expected to last significantly longer). In such cases, you may choose to have the defect remedied by repair or replacement, request an appropriate price reduction, or cancel the purchase. Complaints must be submitted in writing.
11. Seller's Rights in the Event of Buyer's Breach
If you fail to pay or fulfill your obligations under this agreement, and this is not due to circumstances on our side, we reserve the right to withhold the goods, demand fulfillment, cancel the agreement, and/or claim compensation—including interest for late payment, collection fees, and fees for uncollected goods (provided these fees do not exceed our actual delivery expenses). Buyers under 18 are exempt from such fees.
12. Warranty
Any warranty provided by us or the manufacturer supplements your statutory rights. A warranty does not limit your ability to claim remedies for defects or delays under the Consumer Purchase Act.
13. Personal Data
We are the data controller for the personal data collected during your purchase. We will only collect the data necessary to fulfill our obligations under this agreement and will not disclose your data to third parties unless required for order fulfillment or by law. 14. Dispute Resolution and Governing Law
These terms are governed by Norwegian law. Disputes will be resolved in accordance with Norwegian legal provisions. If a dispute arises, we encourage you to contact us to seek an amicable resolution. For Norwegian consumers, if a dispute is not resolved, you may contact the Norwegian Consumer Authority. Consumers in the EU may also use the European Commission’s online dispute resolution portal at http://ec.europa.eu/odr. Please note that for international customers, local consumer protection laws may provide additional rights, but this agreement remains governed by Norwegian law.
15. International Transactions
For orders shipped outside Norway, additional import duties, taxes, and handling fees may be imposed by the destination country’s customs authorities. Such charges are not included in the purchase price and are the buyer’s responsibility. By placing an international order, you acknowledge and accept these potential additional costs. We recommend that international buyers check with their local customs offices for detailed information regarding applicable charges. Additionally, for international shipments, returns or exchanges are not provided free of charge; the customer must arrange and cover the cost of return shipping.
